1. Agreement to Terms
By downloading, installing, or using Chess Reflex: ELO AI Puzzles (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
These Terms apply to all visitors, users, and others who access or use the App.
2. Description of Service
Chess Reflex: ELO AI Puzzles is a mobile application that provides:
- Chess puzzles and challenges
- AI-powered difficulty adjustment
- ELO-based skill tracking
- Educational chess content
- Premium features available through subscription
3. User Accounts
3.1 Account Responsibility
- You are responsible for maintaining the confidentiality of your account
- You agree to accept responsibility for all activities that occur under your account
- You must notify us immediately of any unauthorized use
3.2 Eligibility
- You must be at least 13 years old to use this App
- Users under 18 must have parental consent
- You represent that all information provided is accurate
4. Subscriptions and Purchases
4.1 Premium Subscriptions
- The App offers premium subscriptions with additional features
- Subscription terms and prices are displayed in the App
- Payment will be charged to your App Store account at confirmation of purchase
4.2 Auto-Renewal
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
4.3 Free Trials
- Free trial periods, if offered, are specified in the App
- Any unused portion of a free trial will be forfeited when you purchase a subscription
4.4 Refunds
- All purchases are final and non-refundable, except as required by applicable law
- Refund requests should be directed to the App Store per their policies
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any laws
- Attempt to reverse engineer, decompile, or hack the App
- Use automated systems or software to extract data from the App
- Interfere with or disrupt the App’s functionality
- Violate any intellectual property rights
- Use the App to distribute malware or harmful code
- Impersonate any person or entity
- Collect or store personal data about other users
6. Intellectual Property Rights
6.1 App Content
- All content, features, and functionality of the App are owned by us and are protected by international copyright, trademark, and other intellectual property laws
- The chess puzzles, UI design, and educational content are proprietary
6.2 User License
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes
- This license does not include rights to copy, modify, or distribute the App’s content
6.3 Feedback
- Any feedback, suggestions, or ideas you provide about the App become our property and may be used without compensation to you
7. Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your information.
8. Third-Party Services
The App uses third-party services including:
- Adapty for subscription management and paywall optimization
- Firebase Analytics for app performance monitoring
- App Store for payment processing
These services have their own terms and privacy policies which you should review.
9. Disclaimers
9.1 “As Is” Service
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 No Guarantee
We do not guarantee that:
- The App will be uninterrupted, secure, or error-free
- Results obtained from the App will be accurate or reliable
- Any errors in the App will be corrected
9.3 Educational Purpose
The App is for entertainment and educational purposes only. Chess skill improvements are not guaranteed.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or similar harmful code transmitted through the App
- Any errors or omissions in content
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE PAST TWELVE MONTHS OR $100, WHICHEVER IS LESS.
11. Indemnification
You agree to indemnify, defend, and hold harmless the App, its developers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.
12. Termination
12.1 Termination by You
You may stop using the App at any time by deleting it from your device.
12.2 Termination by Us
We reserve the right to suspend or terminate your access to the App at any time for:
- Violation of these Terms
- Conduct that we believe harms the App or other users
- Extended periods of inactivity
- Request by law enforcement or government agencies
12.3 Effect of Termination
Upon termination, your license to use the App will immediately cease. Provisions that by their nature should survive termination shall survive.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the App shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in these courts.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.
We will notify users of material changes through the App or via email when possible.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
